Focus

KLAUSULA is a peer-reviewed law journal published by the Faculty of Law, Universitas Islam Kadiri (UNISKA) Kediri. The journal focuses on the development, interpretation, implementation, and reform of law, particularly within the fields of Constitutional Law, Administrative Law, Criminal Law, and Civil Law. KLAUSULA provides a scholarly forum for legal research that examines legislation, judicial decisions, public policy, legal institutions, legal enforcement, and legal problems arising in society.

Scope

1. Constitutional Law

Constitutional principles and interpretation; state institutions and separation of powers; democracy and elections; political parties and representation; constitutional rights; central–regional government relations; constitutional adjudication; state finance; constitutionalism; and legal-political developments affecting the constitutional system.

2. Administrative Law

Government authority and administrative action; public services; administrative decisions and disputes; discretion and general principles of good governance; licensing; taxation and regional levies; land administration; environmental governance; public accountability; and regulation of government administration.

3. Criminal Law

Substantive and procedural criminal law; criminal justice policy; corruption and bribery; cybercrime and technology-related offences; money laundering; criminal defamation; restorative justice; juvenile justice; criminal responsibility; law enforcement; victim protection; and reform of the national criminal law system.

4. Civil Law

Contracts and obligations; consumer protection; housing and property law; land rights; family and inheritance law; business and commercial law; banking and financing; employment-related private law issues; civil liability; dispute resolution; and other developments in private law.

Cross-Cutting Legal Themes

KLAUSULA also welcomes legal studies that intersect with the four principal fields above, including:

  • human rights and access to justice;
  • digital law, information law, media, and technological disruption;
  • environmental and natural-resources law;
  • labour and employment regulation;
  • economic, business, banking, and financial regulation;
  • customary and Islamic law where directly connected to contemporary legal issues;
  • international and humanitarian law with relevance to national legal development;
  • comparative law and legal-system studies.

Research Approaches

The journal accepts original legal scholarship using doctrinal/normative, empirical or socio-legal, comparative, statutory, conceptual, historical, case-law, and policy-analysis approaches. Manuscripts are expected to demonstrate a clear legal problem, rigorous argumentation, appropriate use of legal authorities and scholarly literature, and an identifiable contribution to legal scholarship or legal practice.

Out of Scope

Manuscripts that do not contain a substantive legal analysis, fall outside the journal's principal legal fields, present only general social or political discussion without a clear legal framework, or lack a demonstrable connection to legal scholarship will normally not proceed to peer review.
